Terms of Service

Effective Date: August 25, 2025

These Terms of Service (“Terms”) govern your access to and use of Snaptide (“Snaptide,” “we,” “our,” or “us”), including our websites, applications, and services (collectively, the “Service”). By using the Service, you agree to these Terms. If you do not agree, do not use Snaptide.

1) Agreement & Definitions

These Terms form a binding agreement between you and Snaptide. “Photographer” means a user who uploads or manages event galleries. “Guest” means an invited viewer who accesses a gallery, uploads a selfie for matching, or downloads photos. “Content” means photos, images, branding assets, text, and other material you upload to the Service.

2) Eligibility & Accounts

You must be at least 18 years old (or the age of majority in your jurisdiction) to create a Photographer account.
You agree to provide accurate account information and keep it current.
You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

3) Photographer Content & Ownership

You retain all rights in your photos and other Content.
You represent and warrant that you have all necessary rights, licenses, and permissions to upload the Content and to share it with Guests.
You are responsible for obtaining any required consents for identifiable individuals (including minors, where applicable) in your photos.
Snaptide is not a backup service; maintain your own backups of all Content.

4) License You Grant to Snaptide (Hosting & Delivery)

Solely for operating and improving the Service, you grant Snaptide a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, adapt (e.g., generate thumbnails), transmit, display, and distribute your Content to Guests as you direct (e.g., via private event links, download, or purchase options). This license ends when your Content is deleted from active systems, except for limited archival copies retained for compliance, dispute resolution, or backup purposes.

You grant Snaptide permission to display your studio name and branding assets within the Service (e.g., gallery headers, watermarks) to identify your studio to Guests.

5) Guest Use & Gallery Access

Guests may access galleries only via links or methods provided by the Photographer or Snaptide.
Guests may upload a selfie for face recognition to discover photos they appear in. Selfies are processed and then deleted.
Face recognition is probabilistic and may not be perfect; matches should be reviewed where accuracy is critical.
Guests must respect the Photographer’s rights and any download/purchase rules set in the gallery.

6) Acceptable Use Policy

Do not upload Content that is unlawful, infringing, harassing, hateful, or invades privacy.
Do not upload malware or attempt to disrupt, overload, or interfere with the Service.
Do not attempt to bypass security or access Content or systems without authorization.
Do not scrape, reverse engineer, or use automated tools except as permitted by us in writing.
Comply with applicable laws, including consent requirements for photographing and sharing images of individuals (especially minors).

7) Payments, Trials, Renewals & Refunds

If applicable, subscription fees, storage tiers, and download/purchase fees are shown at checkout within the Service.
Payments are processed by payment gateways (e.g., Razorpay/PayPal/Stripe). We may share basic billing info with them to complete transactions.
Plans typically auto-renew until cancelled. You can cancel at any time; cancellation applies at the end of the current billing period.
Except where required by law or expressly stated, fees are non-refundable. Certain promotional trials may have limits or eligibility criteria.
We may suspend or terminate access for unpaid or overdue accounts after notice.

8) Gallery Duration, Deletion & Data Requests

Gallery availability may depend on your plan settings or event configuration.
Photographers or Guests may request deletion of data/photos as described in our Privacy Policy.
Deleted items may persist in backups for a limited time, after which they are purged on a scheduled basis.

9) Service Availability & Beta Notice

Snaptide is currently in beta. Features may change, be added, or be removed. The Service may be unavailable from time to time due to maintenance, upgrades, or network/server issues. We strive for reliability but do not guarantee uninterrupted or error-free operation.

10) Intellectual Property (Snaptide)

The Service, including software, interfaces, designs, logos, and all related intellectual property, is owned by or licensed to Snaptide and protected by law. Except for the limited rights expressly granted here, no rights are transferred to you. Do not use our trademarks without prior written permission.

11) Privacy

Your use of the Service is also governed by our Privacy Policy. Among other things, it explains what data we collect, how we use it, our storage approach (servers in India; separate non-public storage for guest photos), and your rights to request copies or deletion. We do not advertise at-rest encryption for user photos.

12) Third-Party Services

We may use third-party services (e.g., payment processors, analytics). Your use of those services may be subject to their terms and privacy policies. We do not share guest photos or selfies with third-party AI vendors.

13) Copyright Complaints

If you believe Content on the Service infringes your copyright, contact us with: (a) your contact details; (b) a description of the work claimed to be infringed; (c) the URL or location of the material; (d) a statement of good-faith belief that the use is not authorized; and (e) a statement, under penalty of perjury, that the information is accurate and you are authorized to act. 14) Disclaimers (No Warranties)

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT CONTENT WILL BE PRESERVED WITHOUT LOSS.
AI-BASED MATCHING RESULTS MAY CONTAIN ERRORS; YOU ARE RESPONSIBLE FOR REVIEWING OUTPUT WHERE ACCURACY IS CRITICAL.

15) Limitation of Liability

To the maximum extent permitted by law, Snaptide and its affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or related to your use of the Service, even if advised of the possibility of such damages. Our total liability for any claim shall not exceed the amount you paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim.

16) Indemnification

You agree to indemnify and hold harmless Snaptide from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your Content; (b) your use of the Service; (c) your violation of these Terms; or (d) your violation of any law or third-party rights.

17) Suspension & Termination

We may suspend or terminate access to the Service (in whole or part) for violations of these Terms, legal risk, or security concerns.
You may stop using the Service at any time and request account or gallery deletion.
Certain provisions survive termination, including Sections 4 (License to Snaptide—limited survival for backups), 10–16, and 18–20.

18) Governing Law & Disputes

These Terms are governed by the laws of India, without regard to its conflict of laws rules. You agree to submit to the exclusive jurisdiction of the courts located in Punjab, India, for any dispute arising out of or relating to these Terms or the Service.

19) Changes to These Terms

We may update these Terms from time to time. We will post changes here and update the Effective Date above. If you continue using the Service after changes take effect, you agree to the updated Terms.
